Florida Minimum Wage Increase in September 2024

Employees in Florida should know that they may be entitled to a wage increase when Florida’s statewide minimum wage rises on September 30, 2024. Depending on the wage you currently earn, and the type of employee you are, you could be entitled to receive an additional $1.00 per hour, which would also result in an increase in overtime pay. Florida Minimum Wage Increase 

On September 30, 2024, the Florida state minimum wage will increase by $1.00 per hour to $13.00 per hour. The wage for tipped employees will rise to $9.98 (from $8.98).

This wage increase is one of several that Florida voters decided on back in November 2020 by voting for a constitutional amendment designed to eventually raise the state’s minimum wage to $15 per hour for non-exempt employees. The increase in the minimum wage has risen gradually since then. It is scheduled to increase by another $1.00 per hour (to $14.00 per hour) on September 30, 2025, and by another $1.00 per hour (to $15.00 per hour) on September 30, 2026. Each of those years, the minimum wage for tipped employees will also rise by $1.00 per hour, culminating in a minimum wage of $11.98 on September 30, 2026.

Your Minimum Wage Rights as an Employee in Florida 

If you are employed in Florida, it is important to understand your rights when it comes to being paid a minimum wage and overtime pay. Generally speaking, non-exempt employees in Florida cannot be paid an hourly wage below the state minimum wage, cannot have wage deductions made from their paychecks that result in them earning less than the state minimum wage, and cannot be denied overtime pay when they work for more than 40 hours in a workweek.

Beginning on September 30, 2024 and through to September 29, 2025, most non-exempt employees will be able to expect that their employer must pay a minimum wage of $13.00 per hour, or $9.98 for tipped employees. For hours worked beyond the 40-hour workweek, most non-exempt employees will need to be paid one and one-half times their regular rate of pay. For employees making the minimum wage, overtime pay must be paid at $19.50 per hour.
